These Terms of Use are entered into between You and Laura Feil, doing business as Feil Notary & Apostille Services ("Company," "we," "us," or "our").
PARTIES & ELEGIBILITY
The term “you” or “your” refers to any user, client, visitor or purchaser, who accesses or engages www.feilnotary.com (“the Website”), including any content, services, functionality, mobile applications, downloadable materials, legal templates or guides, and courses (“the Services”). By using this website you agree that you are at least 18 years old or of legal age in your applicable jurisdiction and eligible to form a binding contract with the Company.
By accessing or using our website at feilnotary.com (the "Website"), booking an appointment, or engaging our services (collectively, the "Services"), you agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree with these Terms, please do not use our Website or Services.

4. MODIFICATIONS TO THESE TERMS
We reserve the right to update or modify these Terms at any time, at our sole discretion. All changes are effective immediately upon posting to the Website. The "Last Updated" date at the top of this page reflects the most recent revision. It is your responsibility to review these Terms regularly. Your continued use of the Website or Services following any changes constitutes your acceptance of the updated Terms.
5. GENERAL TERMS OF SERVICE
Feil Notary & Apostille Services is operated by a California-commissioned Notary Public. All notarial acts are performed in accordance with California notarial law (California Government Code §§ 8200–8230), applicable state and federal regulations, and the written instructions of the receiving party.
We are not a law firm and do not provide legal advice. All paralegal services (if any) are performed under the direction and supervision of a licensed California attorney when applicable. For legal advice, please consult a licensed California attorney.
All signers must appear willing, aware, and able to sign in our presence, whether in person or via Remote Online Notarization (RON). We reserve the right to decline or discontinue service if a signer appears coerced, intoxicated, mentally incapacitated, or unable to understand the document being signed.
Names on identification documents must reasonably match the names on the document to be notarized. Please provide any written instructions from the receiving party at or before the time of the appointment.
6. IDENTIFICATION REQUIREMENTS
All signers must present a valid, government-issued photo ID at the time of service. Acceptable identification includes, but is not limited to:
• California driver’s license or state-issued ID card
• U.S. passport or passport card
• Military ID
• Foreign passport (when acceptable to the receiving agency)
IDs must be current or within any grace period permitted under California law and accepted by the receiving agency.
7. WITNESS POLICY
Certain documents, including some Wills, Powers of Attorney, and Healthcare Directives, require witnesses. Please note:
• We can arrange witnesses upon advance request. Witness fees apply — please inquire at booking.
• You may bring your own witnesses.
• Witnesses must be disinterested parties: they must not be named in the document and must not benefit from it in any way.
• If the receiving party has specific witness requirements, those requirements take precedence.
8. MOBILE & IN-PERSON APPOINTMENTS
A. Travel & After-Hours Fees
Travel fees and/or after-hours fees may apply depending on your location and appointment time. All applicable fees will be disclosed at booking.
B. Wait Time
A 15-minute grace period is included with every appointment. After the grace period, wait time may be billed in 15-minute increments at our standard rate of $35 per hour.
C. No-Shows & Unable to Proceed
If we arrive at the scheduled location and the appointment cannot proceed (e.g., signer unavailable, documents not ready, or required ID missing), travel and time charges will apply.
D. Appointment Locations
We travel to your preferred location within Sonoma, Mendocino and Lake Counties, including your home, office, care facility, law firm, title company, or any other mutually agreed-upon location.
9. SERVICES OFFERED
A. General Mobile Notary Services
We provide general notarization services for individuals, families, businesses, and attorneys, including:
• Acknowledgments and Jurats
• Oaths, Sworn Statements, and Affirmations
• Signature Witnessing
• Minor Consent / Permission to Travel documents
• Corporate Contracts and Lien Waivers
• Notarized Certification of Work Experience
B. Loan Signing Services
As an NNA Certified and Background-Screened Loan Signing Agent, we handle:
• Purchase and Seller’s Packages
• Refinances and HELOCs
• Reverse Mortgages
We provide prompt scan-backs, same-day document drops, and real-time communication from the signing table to closing.
C. Estate Planning Signings
We partner with families and estate planning attorneys to execute:
• Wills and Trusts
• Powers of Attorney (Financial and Healthcare)
• Healthcare Directives and Advance Health Care Directives
• Affidavits and Declarations
Bilingual (English/Spanish) services are available for Spanish-speaking families and clients.
D. Apostille & Legalization Services
We facilitate the apostille and legalization process for documents intended for international use, including documents destined for Mexico, Central America, South America, and other countries. Our services include:
• Document preparation and submission to the California Secretary of State
• Federal apostilles through the U.S. Department of State when required
• Full legalization coordination for countries outside the Hague Apostille Convention, including embassy and consulate steps
• Pre-acceptance document review to reduce delays
Published processing timeframes are estimates only. Government processing times, office closures, mail delays, and embassy requirements may change without notice. We are not responsible for delays caused by government agencies or third-party carriers.
10. PRICING, FEES & PAYMENTS
Fees for our services are set forth on our Website or provided in a written quote. We reserve the right to update our fees at any time. Quotes are based on the information you provide at booking and the written instructions of the receiving party. If the scope of services changes, pricing may be adjusted.
Payment is due at the time of booking or at the appointment, as agreed. We accept major credit and debit cards, cash and approved digital payment methods.
You represent and warrant that all payment information you provide, including billing address and card details, is accurate and that you are authorized to use the payment method. Where a payment plan is established, you agree to pay in accordance with the terms of that plan. Past-due balances may accrue interest at 1.5% per month or the highest rate permitted under applicable California law, whichever is lower.
You agree to contact us directly to resolve any billing concern before initiating a chargeback with your financial institution. Disputed payments that result in the reversal of a valid charge may be referred to collections for the unpaid balance plus applicable bank dispute fees. We reserve the right to present proof of your consent to these Terms and your receipt of services to your financial institution in connection with any disputed charge.
11. REFUND POLICY
• Notary Services: Once a notarization has been completed, fees are non-refundable.
• Apostille & Legalization: If you cancel before we submit your documents to any government office, we will refund the service fee less any costs already incurred. After submission, service fees are non-refundable. Government fees, courier fees, and shipping already paid on your behalf are non-refundable.
• If services are governed by a separate written engagement agreement, the terms of that agreement shall control with respect to refunds.
12. RESCHEDULING & CANCELLATIONS
A. Client Reschedules
You may reschedule your appointment once at no charge with at least 12 hours’ advance notice. Reschedule requests with less than 12 hours’ notice may incur a rescheduling fee.
B. Provider Reschedules
In the unlikely event that we must reschedule, we will offer the next available time or refer you to a trusted notary partner at no additional charge to you.
C. Weather & Emergencies
Safety comes first. In the event of extreme weather, road hazards, or other emergencies, we will coordinate the earliest practical alternative appointment at no charge.
13. SHIPPING & DOCUMENT HANDLING
We can return completed documents via trackable courier or postal service. Once a carrier has accepted the package, we are not responsible for delays, loss, or damage during transit. Carrier insurance is available upon request.
Scan-backs and digital copies of loan documents will be transmitted promptly as required by escrow, title, or lender instructions.
14. DOCUMENT ACCEPTANCE
We make every effort to confirm document acceptance requirements with the receiving party and follow their written instructions. However, final acceptance of notarized documents is always at the sole discretion of the receiving agency, lender, court, escrow company, or embassy. If a document is rejected due to an error on our part, we will correct the notarization at no additional charge.
15. RIGHT TO REFUSE SERVICE
Feil Notary reserves the right to refuse or discontinue service in any of the following circumstances:
• Suspected fraud or document falsification
• Incomplete, blank, or altered documents
• Failure to present acceptable identification
• A signer who appears coerced, intoxicated, or unable to understand the document
• Threatening or abusive behavior toward our notary
• Any situation that violates California law or professional notarial standards
16. BILINGUAL & ACCESSIBILITY SERVICES
Our services are available in English and Spanish (Servicios disponibles en inglés y español). All signers must understand the document(s) they are signing. If an interpreter is required by the receiving party or necessary for the signer’s comprehension, please arrange one in advance. We do not serve as interpreters for document content beyond our standard bilingual notarial services.
17. WEBSITE USE & INTELLECTUAL PROPERTY
A. Personal Use Only
The Website and its content are provided solely for personal, non-commercial use. You may not use our content or materials for any commercial purpose or for any public display without our prior written consent.
B. Intellectual Property Rights
All content on feilnotary.com, including but not limited to text, images, graphics, logos, branding, and the arrangement thereof, is owned by or licensed to Feil Notary & Apostille Services and is protected by applicable copyright, trademark, and intellectual property laws. The Feil Notary name, logo, and related marks may not be used without our prior written consent.
C. No Reproduction
You may not reproduce, distribute, modify, create derivative works of, republish, transmit, sell, or otherwise exploit any content from our Website, except that you may print or download one copy of a reasonable number of pages solely for your own personal, non-commercial reference.
D. Copyright Infringement Notice

24. LIMITATION OF LIABILITY
To the maximum extent permitted under California law, Feil Notary & Apostille Services and its owner shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Website or Services, including but not limited to: loss of revenue or profits; loss of business or contracts; loss of data; or any indirect or consequential loss, whether foreseeable or not, and whether caused by negligence, breach of contract, or otherwise.
This limitation does not affect any liability that cannot be excluded or limited under applicable California law, including liability arising from gross negligence or willful misconduct in the performance of notarial acts.
25. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Feil Notary & Apostille Services, its owner, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your use of the Website or Services; (ii) your violation of these Terms; (iii) your submission of false, incomplete, or misleading information; or (iv) your use of any information obtained from our Website in a manner not authorized by these Terms.
26. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.
27. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Feil Notary & Apostille Services with respect to your use of the Website and Services and supersede all prior agreements, negotiations, representations, and understandings relating to the same subject matter. Where a separate written service agreement or engagement letter has been executed, that agreement shall control with respect to the specific services covered therein.
28. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice-of-law or conflict-of-law provisions. Any dispute arising under or related to these Terms or our Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Sonoma County, California, and you hereby consent to personal jurisdiction in those courts.
29. DISPUTE RESOLUTION
We encourage you to contact us first to resolve any concern informally. Most issues can be resolved quickly and directly. If informal resolution is not possible, any dispute, controversy, or claim arising out of or relating to these Terms or our Services shall be resolved by the exclusive jurisdiction of the state or federal courts located in Sonoma County, California. You and Feil Notary & Apostille Services hereby consent to personal jurisdiction in those courts and waive any objection to venue or jurisdiction therein. Each party shall bear its own legal fees and costs unless otherwise ordered by the court.
You and Feil Notary & Apostille Services agree to resolve disputes only on an individual basis.
30.LIMITATION ON TIME TO FILE CLAIMS
Any cause of action or claim you may have arising out of or relating to these Terms or the use of our Services must be commenced within one (1) year after the cause of action accrues. After that period, such cause of action or claim is permanently barred, to the fullest extent permitted by applicable California law.
